Export Control Program (ECP)

Export Control Program is the corporate compliance procedure of export control laws. Export control laws are the regulations that control the conditions under which certain information, technologies and commodities that can be transferred / transmitted overseas to anyone. The laws prohibit the unlicensed export of certain materials or information for reasons of national, international security or protection of trade.

Toshiba Embedded Software (India) Pvt. Ltd., being a member of Toshiba group and a peaceful and responsible corporate citizen, shall follow the Toshiba framework of export control policy and shall comply by all the applicable laws without engaging in any transactions that could undermine National and International peace and security.

The key objectives under TESI ECP are:

	To cover the key elements of relevant Indian Export Control Regulations, compliance standards of Toshiba ECP covering the export control regulations of Japan, U.S., Europe and relevant export control regimes for compliance processes.
	Realizing the above statutory key elements under TESI ECP in its Program Philosophy, Procedural Manual, training materials/awareness and workflow Systems.
	Strategic Implementation of all the statutory key elements under TESI ECP.
	Establishment of TESI ECP Organization with an ECP Advisory Board assigning the roles and responsibilities for the respective employees in reviewing the transaction, screening the end-user, verification, confirmation and authorization.
	To comply with the foremost objectives of Product Validation and End-user Screening following the procedures as defined in the TESI Export Control Program philosophy and Procedural Manual.
	To minimize the risks and improve decisions relating to compliance issues across TESI.

The policy guidelines under the Export Control Program are applicable to all of TESI directors, designated ECP Manager, and employees during any release, transfer, re-transfer and trans-shipment of any TESI “Product” including within its definition samples, services, technical data and software from TESI.

TESI ECP covers within its scope, all relevant aspects based on the Toshiba framework bounded by the triangle of Program Philosophy/Procedural Manual, Training Materials and the workflow systems.
